The Judicial Council adopts legal forms in one of two ways. Under Government Code section 68511, the council may "prescribe" certain forms. Use of those forms is mandatory. The council may also "approve" forms.

Proof of service: The process server must file proof of service with the court to confirm that the documents were served properly. The proof of service provides evidence that the individual was notified of the legal action against them.

Tells the court that you had legal papers in a civil case - other than a summons - delivered to (served on) the other party. Lists the papers that were served and tells who they were served on, where, when, and how they were served, and who served them.

To do this, the process server must carefully fill out and sign the Proof of Service detailing how service was done, on whom, where, and when. The process server then gives you the Proof of Service. Make a copy of the Proof of Service. Take the original and copy to your court clerk right away to file it.

The person who serves the tenant must sign court paperwork showing when the tenant was served. This paper is called "Proof of Service." The tenant must be served by a certain date and the proof of service must be filed with the court clerk.

Tells the court that you had the other party served legal papers by mail.

List each document that you served. If you need more space, check the box in item 4, complete the Attachment to Proof of Service—Civil (Documents Served) (form POS-040(D)), and attach it to form POS-040. Provide the names, addresses, and other applicable information about the persons served.
