As authorized by the Clean Water Act, the NPDES Permit Program controls water pollution by regulating point sources that discharge pollutants into waters of the United States.

In Washington, EPA issues NPDES permits for federally-owned facilities and permits on tribal lands (see table below). EPA has delegated authority to issue other NPDES permits to the Washington Department of Ecology.

EPA's Pacific Southwest (Region 9) issues NPDES permits for any discharges into federal ocean waters. All other permits are issued by the California Environmental Protection Agency (CalEPA).

Under the CWA, EPA authorizes the NPDES permit program to state, tribal, and territorial governments, enabling them to perform many of the permitting, administrative, and enforcement aspects of the NPDES program. In states authorized to implement CWA programs, EPA retains oversight responsibilities.
