The compensation of a veteran who died in the active armed forces duty in the Vietnam theatre of operations or as a result of disease, wound, or injury incurred in the Vietnam theatre of operations, or those missing in action who have not been declared dead or captured shall be one thousand dollars ($1,000).

Death Gratuity Payment Military services provide payment, called a death gratuity, in the amount of $100,000 to the next of kin of Servicemembers who die while on active duty (including those who die within 120 days of separation) as a result of service-connected injury or illness.

The military death gratuity, the Defense Department calls it. It is a one-time payment of $12,000 to the survivors of military men and women killed in the line of duty. Among the things it paid for were the dark clothes that Corporal Ryan's sister, Lauren, 23, wore to the funeral.

The death gratuity program provides for a special tax free payment of $100,000 to eligible survivors of members of the Armed Forces, who die while on active duty or while serving in certain reserve statuses. The death gratuity is the same regardless of the cause of death.

The death gratuity program, first established in 1908, has a long history and has evolved to support surviving family members more effectively. Prior to the creation of the program, survivors were left financially vulnerable after the death of their military service member.

If a person entitled to all or a portion of a death gratuity dies before the person recieves the death gratuity, it shall be paid to the living survivor next in the order prescribed. Members may designate eligible survivors, at any time, by updating their DD Form 93, Record of Emergency Data.
