Deeds in NSW (e.g. Deed of Indemnity or Confidentiality Deed) May be executed electronically by the individual inserting their own2 electronic signature onto the deed and can be witnessed by the witness inserting their own electronic signature onto the deed.

As long as the family member is not to benefit from the document being signed, and meets the general requirements of age and capacity, they are likely to be a valid witness.

Deeds in England and Wales are written documents that must be executed (ie signed) in a certain manner in order to be legally binding. They carry a higher degree of formality (and are, therefore, usually stronger evidence of a legal commitment) than a simple contract.

Under the Electronic Transactions Act 2000 (TAS), electronic signatures are acceptable on certain types of Documents (such as agreements), if signed in ance with section 7. Deeds can only be physically created, wet-signed and witnessed in person.

A party to the deed cannot witness the signature of another party to the deed (Seal v Claridge (1881) 7 QBD 516 at 519). The relevant legislation does not prevent a signatory's spouse, civil partner or cohabitee from acting as a witness (if they are not a party to a deed), but this is best avoided.

A neutral third party is the best choice. A neutral third party is someone not related to either party and who does not benefit from the document. A witness does not have to read the document but they must be present when it is signed.
