A “motion for a continuance” is a request asking the judge to make an order changing your hearing date. If the judge grants your motion, your court date will be postponed to a later time. For most requests for continuances, you must provide the judge with a suitable reason (“good cause”) for postponing your court date.

Order on Request to Reschedule Hearing (form FL-309) must be used for this purpose. You should complete and file with the court a written request to reschedule the hearing and a proposed order at least five court days before the hearing, unless you have a very good reason to submit them later.

To get a change of venue in a California family law case, you must file a motion for change of venue with the court where your case is currently filed. The court will consider your motion (otherwise known as a “request for order”) along with your supporting declaration.

Orders (form FL-306) (b) Either party may request a continuance of the hearing, which the court shall grant on a showing of good cause. The request may be made in writing before or at the hearing or orally at the hearing. The court may also grant a continuance on its own motion.

If you want to change your court date, you must ask for a postponement (also called a "continuance"). To ask for a postponement at least 10 days before your trial: File a Request to Postpone Trial (Small Claims) (Form SC-150. ), OR.

If you are the defendant, you can request a postponement (continuance) of your trial date if you 1) are unable to appear on that date, or 2) you were untimely served and need more time to prepare for the trial.
