Section 106(9) of the Town and Country Planning Act 1990 (as substituted by section 12 of the Planning and Compensation Act 1991) states that a planning obligation may not be entered into except by an instrument (that is to say, a formal legal document) executed as a deed.

Planning and regeneration Additional Planning Guidance Article 3 stipulates that there is no permitted development for anything which creates an obstruction to the view of persons using any highway used by vehicular traffic and which causes them danger.

Section 215 (s215) of the Town & Country Planning Act 1990 (the Act) provides a local planning authority (LPA) with the power, in certain circumstances, to take steps requiring land to be cleaned up when its condition adversely affects the amenity of the area.
