The U.S. Virgin Islands are an unincorporated territory of the United States. Many but not all federal laws apply to the U.S. Virgin Islands. In addition to the U.S. Constitution, which is the supreme law of the U.S., federal laws include statutes that are periodically codified in the U.S. Code.

The Court's Jurisdiction The Court has appellate jurisdiction (the Court can hear the case on appeal) on almost any other case that involves a point of constitutional and/or federal law.

In ance with Supreme Court Rule 201(a), an Attorney who is not regularly or specially admitted to practice law in the Virgin Islands may be specially admitted, Pro Hac Vice. This requires a motion of an attorney who is regularly admitted to practice in the Virgin Islands.

Either party in a traffic matter has a right to appeal a judge's decision. On appeal you are not allowed to present new facts or to retry old facts. Virgin Islands Superior Court Rule 322 governs appeals of all final orders or judgments of a Magistrate Judge that presided over a Non-Felony Traffic Offense Division.

The Court of Appeal is an itinerant court, and moves from island to island throughout the year in scheduled sittings. It usually sits three times per year in each territory. Each territory has a fixed High Court that remains active in the particular territory throughout the year.

The Virgin Islands Supreme Court is the equivalent of a state supreme court. As the highest court for the Virgin Islands, the Supreme Court is authorized to review all final orders, judgments and specified interlocutory orders of the Superior Court of the Virgin Islands.

The functions of the ECSC are as follows: To interpret and apply the laws of the various member states of the OECS; To decide cases of both civil and criminal matters; To hear appeals.
