Where minor injuries have a $3,500 cap, non-catastrophic injuries have a cap of $65,000–that cap is a combined limit for medical, rehabilitation and attendant care costs.

Someone with minor injuries only has access to a maximum of $3,500 for medical and rehabilitation benefits, whereas non-MIG injuries have access to up to $50,000 in benefits. Furthermore, accident victims' injuries might be wrongly, unjustly or prematurely labeled as minor in the industry's attempt to cut corners.

The OCF-23 is the form used by a Facility and/or associated Provider to inform an Insurer that treatment for an injured person will commence within the Minor Injury Guideline (MIG). If an Insurer confirms that the injured person has a valid policy, treatment in the OCF-23 does not require prior Insurer approval.

The cap was $100,000.00 in 1978 (January 19, 1978, was the date of the three decisions mentioned above) and is adjusted for inflation to determine the cap at the time of trial. The courts in Ontario will apply the cap but will adjust for inflation. As of 2022, the cap is around $418,000, due to inflation.

The $100,000 upper limit on pain and suffering, when adjusted for inflation from 1978 to 2022, is currently approximately $380,000, for the most severe cases. In other words, for the most seriously injured plaintiff, the most one can expect to recover for pain and suffering is $380,000.
