This law ensures that a copyright is given to a person as soon the person creates the original piece of work. In Malaysia, the primary copyright law is the Copyright Act 1987.

Copyright law in Malaysia is governed by the Copyright Act 1987. Under the Act and pursuant to the Berne Convention, copyright exists automatically upon the creation of a work without the need for any formal registration.

In Malaysia, copyright in literary, musical and artistic works subsists during the life of the creator and continues 50 years after his/her death. This means that the estate of the deceased author, artist or designer can benefit from the copyright for a further 50 years.

Definition of Copyright Copyright is the exclusive right to control creative works created by the author, copyright owner and performer for a specific period governed under the Copyright Act 1987.

The three distinct standards of originality in Malaysian copyright law are sufficient efforts, newness or quality, and expertise in selecting and compiling.

In Malaysia, copyright registration is not a legal requirement. This is because an original work's creator receives rights over it after making a claim. That being said, it is highly advisable for creators to undergo copyright registration in Malaysia and obtain intellectual property protection.

Copyrights are granted automatically to author upon fulfilling the following criteria: Original irrespective of its quality. Sufficient independent skill and effort expended. Works created by a qualified person. Reduced or transformed to material form.
