Get Public Information Release Report

A hazardous material spill is a spill in which there is a significant amount of a hazardous material released or one in which the release of the substance cannot be controlled.

In California, any significant release or threatened release of a hazardous material requires immediate reporting by the responsible person to the Cal OES State Warning Center (800) 852-7550 and the Unified Program Agency (UPA) or 911. The UPA may designate a call to 911 as meeting the requirement to call them.

State Law requires that an unauthorized discharge of sewage into or onto state waters must be reported to the Cal OES Warning Center. The Reportable Quantity for sewage spills is 1000 gallons or more, as established in regulation (Title 23, CCR, §2250 (a)).

If a hazardous substance is released to the environment in an amount that equals or exceeds its reportable quantities, it must be reported immediately to the National Response Center 24-hour hotline at (800) 424-8802. State reporting requirements must also be followed.

More than 42 U.S. gallons of oil in each of two discharges to navigable waters or adjoining shorelines occurring within any twelve-month period.

Reportable chemical spill quantities are those listed for hazardous substances under Superfund, or as extremely hazardous substances under the Superfund Reauthorization and Amendments Act of 1986 (SARA), the emergency planning statute which also establishes threshold planning quantities (29 Ill. Admin. Code § 430.30).

Any release that exceeds 25 gallons must be reported within 24 hours of discovery. A release less than 25 gallons that is not contained and cleaned up within 24 hours must be reported immediately.

Police reports are considered ! public records' within the meaning of the California Public Records Act and the San Francisco Sunshine Ordinance. Police reports must be released unless an exception applies. (Reference DGO 3.16, Release of Police Reports.)
