Jessica's Law is known nationally, but it's a California law that was passed in 2006 as proposition 83. What the law did was to increase punishment for sex offenders and prohibited probation for some sex offenses. It also extended parole and allowed for GPS monitoring for many paroled sex offenders.

Under the California Penal Code Section 290, if you have been charged with a sex crime, you must register and re-register as a sex offender for the rest of your life so long as you are residing or working in California. Registration must be done within five business days of coming to a particular area to live.

When California voters approved Jessica's Law in 2006, the goal was simple: to keep sex offenders away from children. The sweeping measure prohibited all sex offenders from living within 2,000 feet of schools and parks where children gather, regardless of whether their crimes involved children.

Proposition 83—JESSICA'S LAW—will protect our children by keeping child molesters in prison longer; keeping them away from schools and parks; and monitoring their movements after they are released. A rape or sexual assault occurs every two minutes. A child is abused or neglected every 35 seconds.

In a recent ruling, the California Supreme Court overturned Jessica's Law, a law enacted in 2006 that prohibited convicted sex offenders from living within 2,000 feet of a school or park, in San Diego County.

After Jessica's death, her father, Mark Lunsford, pushed for new legislation to strengthen regulations on tracking released sexual offenders. Jessica's Law was passed in Florida in 2005. The act mandates a minimum sentence of 25 years and a maximum of life in prison for first-time child sex offenders.
