Per the CMS Final Rule 2024 (opens in a new window), all Scope of Appointment forms must be gathered at least 48 hours before the appointment — and this time limit should be taken literally.

The Scope of Appointment form is used to document an in-person appointment with a beneficiary to ensure that no other types of products are discussed outside of what the beneficiary originally requested.

Exceptions to the rule One exception to the rule is during the last four days of a valid election period. During this time, agents are permitted to get a same day Scope. The second exception is when the beneficiary walks into the agent's office without a scheduled appointment.

When must the scope of appointment be obtained for an in-person or telephonic sales presentation? Agents must obtain a scope of appointment no less than 48 hours prior to presenting and enrolling a beneficiary into a plan.

Scope of Appointment (SOA) forms are valid for 12 months. Aside from having a valid SOA for your current appointment, we encourage you to have your clients sign another one at the end of their appointment. That'll alleviate the need to wait 48 hours in the future as SOAs are valid for a full 12 months.

Requirements for a Valid Scope of Appointment Agents should not create and use their own form. Prospect must initial the product(s) they agree can be discussed at the appointment, sign, and return the SOA to the agent. The agent must complete all of the fields in the “Agent Only” area of the form.

Is an SOA form required for an agent to meet with an existing client? Yes. The CMS Scope of Appointment rule doesn't differentiate between current and prospective clients. You must collect an SOA before appointments with both current and prospective clients.

For SilverScript, a Scope of Appointment is needed whenever the agent has a meeting, regardless of venue. Agents must confirm that the client has signed the completed paper Enrollment Application. Agents must sign and date the completed paper Enrollment Application before sending it to SilverScript.
