1253. An unemployed individual is eligible to receive unemployment compensation benefits with respect to any week only if the director finds that: (a) A claim for benefits with respect to that week has been made in ance with authorized regulations.

The state Employment Development Department and the Center for Workers' Rights, a consumer advocacy group, signed an agreement Friday, that EDD will not pursue claimants that it retroactively decided were not entitled to benefits.

After receiving this information, the EDD will determine if the base period employer's reserve account should be charged for the employee's claim for unemployment benefits. If the base period employer fails to respond within 15 days, the base period employer's reserve account will likely be charged.

If you do sign a repayment agreement, the EDD has 4 years from the signing of that agreement to file a lawsuit against you for repayment.

The DWP can agree to waiver (write off) the overpayment. However this will usually only be done in exceptional circumstances where recovery action will result in severe welfare issues for you or your family. The DWP will also look into the circumstances of the overpayment.
