The U.S. federal government passed the Miller Act in 1935 when facilities and infrastructure construction was booming. The Miller Act (40 U.S.C. Section 3131 to 3134), as implemented by the Federal Acquisition Regulation (FAR), requires contractors to get surety bonds for federal projects over $150,000.

A payment bond is a type of surety bond issued to contractors which guarantee that all entities involved with the project will be paid. A payment surety bond is a legal contract, a type of bond, that guarantees certain employees, subcontractors, and suppliers are protected against non-payment.

A payment bond is a type of surety bond issued to contractors which guarantee that all entities involved with the project will be paid. A payment surety bond is a legal contract, a type of bond, that guarantees certain employees, subcontractors, and suppliers are protected against non-payment.

The Miller Act requires that prime contractors for the construction, alteration, or repair of Federal buildings furnish a payment bond for contracts in excess of $100,000. Other payment protections may be provided for contracts between $30,000 and $100,000.

A Miller Act payment bond is a creature of federal law—not state common law. Under the Miller Act, subcontractors have a right to pursue legal action against the surety if the contractor fails or refuses to pay for labor, services or materials provided for the bonded project.

The Miller Act (ch. 642, Sec. 1-3, 49 stat. 793,794, codified as amended in Title 40 of the United States Code) requires prime contractors on some government construction contracts to post bonds guaranteeing both the performance of their contractual duties and the payment of their subcontractors and material suppliers.

The three main types of construction bonds are bid, performance, and payment.

Enacted in 1935, the Miller Act requires that, before any contract exceeding $100,000 is awarded for the construction, alteration or repair of any building or public work of the United States, the construction contractor must furnish a payment bond and a performance bond.

When is the deadline to initiate suit, or, how long is my California Bond Claim effective? An action to enforce a claim on the contractor's bond must be initiated after all material and/or labor is furnished by the claimant, but within 6 months after the time in which a stop notice may be given.

Performance bonds are used to ensure satisfactory completion of contracted work. If a contractor is unable to deliver on their obligations, a performance bond allows the paying party to cover any additional costs due to their failure to deliver.
