(PA-20S/PA-65 ES (P/S)) The PA-20S/PA-65 ES (P/S) is used by a partnership or PA S corporation, to remit its nonresident withholding tax payments. These instructions provide information regarding the nonresident withholding tax.

A partnership must file a PA-20S/PA-65 Information Return to report the income, deductions, gains, losses etc. from their operations. The partnership passes through any profits (losses) to the resident and nonresident partners.

An S corporation is subject to Pennsylvania corporate net income tax only to the extent of its built-in gains. Some states require an S corporation to make a separate S corporation election at the state level, but Pennsylvania no longer requires that.

Who Must File. A partnership (including REMICs classified as partnerships) that engages in a trade or business in California or has income from a California source must file Form 565.

A partnership wholly owned by one or more C corporations submits PA-65 Corp and a complete copy of federal Form 1065, including all federal schedules and federal Form 1065 Schedules K-1.
