In addition to local hotel occupancy taxes, all lodging properties operating in Texas are subject to a six percent state hotel occupancy tax. 7 Governed under Chapter 156 of the Texas Tax Code, the state hotel occupancy tax is administered by the Texas Comptroller.

The 6 percent state hotel tax applies to any room or space in a hotel, including meeting and banquet rooms. Local hotel taxes, however, are due only on those rooms ordinarily used for sleeping.

An exemption certificate must show: (1) the name and address of the purchaser; (2) a description of the item to be purchased; (3) the reason the purchase is exempt from tax; (4) the signature of the purchaser and the date; and. (5) the name and address of the seller.
