A parenting plan is not automatically legally binding. However, there is the option of formalising the agreement through a Consent Order.

This is a Court Order which is designed to give you support and guidance. It aims to help you prevent your child from offending and/or antisocial behaviour and/or help you get them to attend school every day, and/or address issues of behaviour at school after they have been excluded.

The court will order parenting time in most cases. Children have the right to spend time with both parents, unless a judge or referee finds there is clear and convincing evidence that it would be a danger to the child's physical, mental, or emotional health.

You'll need to pay the court clerk $314 to open your divorce, legal separation or annulment case. For parents seeking custody who aren't married to each other, the fee is $260. If you can't pay, submit a motion asking the court to waive fees.

A parent alleging a violation of the custody order must file a motion that “stat[es] the specific facts which constitute a violation.” Once the motion has been filed, the court clerk must issue a summons to the other parent within five days.

Only a Tennessee court can legally modify and enforce a parenting plan.
