NINE PROTECTED TRAITS UNDER HOUSING: Race, color, sex, religion, national origin, marital status, familial status (having children younger than 18), handicap or disability or elderliness (age 55+).

So, for example, if a tenant claimed you discriminated against them based on marital status, the tenant could not bring a complaint under the FHA, since marital status is not a protected class under the FHA.

The court declared that the civil right act of 1866 prohibits all racial discrimination in the sale and rental of real property. Seven protected Classes? The FHA, to date, includes seven protected classes: race, color, religion, national origin, sex, disability, and familial status.

The Fair Housing Act makes it illegal to harass persons because of race, color, religion, sex (including gender identity and sexual orientation), disability, familial status, or national origin.

(2) Public Law 90–284, which is the Fair Housing Act (42 U.S.C. 3601–3620). In ance with the Fair Housing Act, the Secretary requires that grantees administer all programs and activities related to housing and community development in a manner to affirmatively further the policies of the Fair Housing Act.

The Rumford Fair Housing Act ( Health & Saf. Code, §§ 35700- 35744) prohibits discrimination only in the sale or rental of public assisted housing accommodations and in any private dwelling containing more than four units. ( Health & Saf. Code, §§ 35710, 35720.)

The seven federally protected classes are race, religion, national origin, color, familial status, sex, and disability. These classes or characteristics are protected under the federal Fair Housing Act.
