Landlords cannot evict a tenant without receiving a court order. It is illegal for a landlord to try to evict a tenant through any other means, such as shutting off utilities (see OCGA § 44-7-14.1) or changing the locks at the rental unit. Such actions are called self-help evictions.

A Georgia 60 Day Notice to Vacate is an official lease termination letter to end a tenancy at will or a month-to-month lease. [1] This notice may also be used for tenants that do not have a written lease that pay rent monthly or for tenants with an expired lease.

Or, if the tenant is unavailable, a copy can be sent through certified mail. After receiving the Dispossessory Affidavit, the tenant will have 7 days to respond to the court. If the tenant fails to provide a written or oral response, the landlord wins by default, and an eviction may be requested on the eighth day.

Once a writ of possession is issued, an eviction must be requested within thirty (30) days of the date of service or a newLandlord-Tenant (Dispossessory) Affidavit must be filed.

You must provide 30 days' notice (half the notice that landlords must provide). Be sure to check your rental agreement which may require that your notice to end the tenancy be given on the first of the month or on another specific date.

After the hearing, the judge will decide whether you should be evicted. If you are evicted, you will generally have seven days to leave the property. If you are behind on your rent, you may qualify for rental assistance.

It gives the tenant 7 days to move out of the property, or else the sheriff will come over and physically remove them. During this 7 day period, the tenant can file an appeal from the trial court to a higher court. If this happens, the landlord can ask the court to order the tenant to pay rent into the court registry.
