Restraining orders are court orders to protect you from someone else. They are public records, but their contents are confidential.

Under the Missouri Child Protection Orders Act, Sections 455.500 through 455.538, RSMo, a person may seek an order of protection on behalf of a child (person under 17 years of age unless otherwise emancipated) who has been the victim of child abuse, sexual assault, or stalking.

An order of protection is an order issued by a Missouri court pursuant to the Domestic Violence Act that restrains a person from abusing, stalking, sexually assaulting, or harassing another person. Unlike a restraining order, an order of protection carries criminal penalties for violation.

A Court of Protection order can be issued when someone loses mental capacity and there is no lasting power of attorney or enduring power of attorney in existence.

A full order of protection may be granted by the court after a hearing on the petition. Hearings regarding full orders of protection must be conducted on the record (so a transcript may be made).

The expungement process involves filing a request through the clerk's office and verifying your eligibility. It's best to have a lawyer help you petition the Court for an expungement. If you lose the Order of Protection hearing, you will not be able to expunge the order from your public record.
