Get Subletting

The lease determines whether a tenant can sublet. Often, subletting requires the landlord's permission. A subtenant has the right to use and occupy the rental property from the original tenant and not directly from the landlord.

In Arizona, a renter cannot sublease without the landlord's consent. Subletting your rental unit must be requested in writing, and it must be sent by certified mail for delivery confirmation.

Make sure your contract allows subletting and get permission from your landlord. Subletting without permission is a breach of contract and your landlord could evict you and your subtenant.

It is not against the law Under California laws, subletting a property is not illegal on the face of it. However, the buck stops with the lease agreement in place. Landlords can legally prevent their tenants from subletting a property by explicitly stating so in the lease.

Subletting is risky. It comes with the same risks as taking on a roommate, except both people won't be there to deal with problems as they arise. If a tenant's subletter skips town or damages the apartment, the tenant is jointly and severally liable with them and could get stuck with the bill.

If you want to sublease your room or rental unit, you need a sublease contract, which is a written agreement that acts as a lease within a lease. It allows the original tenant (sublessor) to rent out their room, apartment, house, or other rental property to a subtenant (sublessee) for a limited time period.

It's illegal for a council or housing association tenant to sublet the whole of their home. If you're living in an unlawful sublet, you will not be breaking the law as a subtenant.

You can sublet part of your home with your landlord's written permission. If you sublet part of your home without permission, you are in breach of your tenancy agreement. Your landlord can't unreasonably withhold their consent to a request to sublet part of your home.
