Article I, Section 1 provides: “All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and a House of Representatives.” The Constitution first vests all federal legislative powers in a representative bicameral Congress.

Article I of the Constitution enumerates the powers of Congress and the specific areas in which it may legislate. Congress is also empowered to enact laws deemed “necessary and proper” for the execution of the powers given to any part of the government under the Constitution.

Under Article One, Congress is a bicameral legislature consisting of the House of Representatives and the Senate. Article One grants Congress various enumerated powers and the ability to pass laws "necessary and proper" to carry out those powers.

Its first three words – “We The People” – affirm that the government of the United States exists to serve its citizens. The supremacy of the people through their elected representatives is recognized in Article I, which creates a Congress consisting of a Senate and a House of Representatives.

The founders considered this and determined that a two-chambered legislature would be the most advantageous. Two chambers would provide an additional layer of checks and balances within Congress. James Madison noted that bicameralism would create two “different bodies of men who might watch and check each other."

The first section, as we read above, makes our Congress bicameral. Bicameral means that Congress has two houses: the House of Representative and the Senate. We have the two houses of Congress due to a compromise made by the Founding Fathers during the Constitutional Convention.

The Founders of the U.S. established a bicameral legislature in order to create a separation of powers. At the constitutional convention, larger states (mostly in the South) and smaller states (in the North) began to quarrel over which should wield more power at the federal level.
