It is no longer in the replacement document except as a reference to not requiring a "U" marking in the banner or footer signifying unclassified information as was required with the "old FOUO marking" (para 3.4. b. (1)).

Question: What is the difference between U//FOUO and CUI? Answer: U//FOUO is a legacy marking used to indicate sensitivity based on agency policy or practice. CUI is a marking that is used to indicate the presence of CUI basic information.

For Official Use Only (FOUO) is a document designation, not a classification. This designation is used by Department of Defense and a number of other federal agencies to identify information or material which, although unclassified, may not be appropriate for public release.

Safeguarding CUI or FOUO Information CUI or FOUO documents may be transmitted via email but should be protected by encrypted or transmitted by secure communications systems when possible.

FOUO documents and material may be transmitted via first class mail, parcel post, or -- for bulk shipments -- fourth class mail. Fax or e-mail transmission of FOUO information (voice, data or facsimile) should be by encrypted communications systems whenever practical.
