An attorney files a Notice of Appearance, making it known to the court that she or he is representing a specific individual. The person/party appealing the judgment or decision of a court.

Generally, your Summons and Complaint must be served within 90 days after you file the Complaint. (ARCP 4(i)) If you fail to serve the Defendants within 90 days, your Complaint will be dismissed.

Proof of service when necessary shall be made by filing with the clerk of the court of the county in which the case is pending a statement of the date and manner of service and of the names of the persons served, certified by the person who made service.

If it is not filed in 45 days the claim will be dismissed.

The plaintiff files a document (complaint) with the clerk of the court stating the reasons why the plaintiff is suing the defendant, and what action the plaintiff wants the court to take. A copy of the complaint and a summons are delivered to (served on) the defendant.

Any individual, partnership, association or corporation may file a small claims suit for a situation in which the dispute is for $3,500 or less. Attorneys are not allowed in small claims court unless both parties agree. The Arizona Supreme Court publishes and routinely updates its Rules of Small Claims Procedure.
