In 2003, the Rule 23 was amended to clarify that court approval is not required before a class has been certified. The rule now provides that “[t]he claims, issues, or defenses of a certified class may be settled, voluntarily dismissed, or compromised only with the court's approval.” Fed. R. Civ.

(1) In General. On timely motion, the court may permit any person to intervene who: (A) is given a conditional right to intervene by an applicable law; or (B) has a claim or defense that shares with the pending action a common question of law or fact. (2) Delay or Prejudice.
