Get Appeal Edd 2019-2024

The appeal must be filed (postmarked) within 30 calendar days of the mailing date on your EDD Notice of Determination. If you do not file within the allotted time, your appeal could be denied unless you, or whoever is representing you at your hearing, are able to show good cause for a late filing.

You can download the Appeal Form (DE 1000M) (PDF) or use the copy included with the Notice of Determination that you receive. Mail your appeal to the return address shown on the decision notice. You can also write a letter to the EDD.

A disqualification assessed under Section 1257(a) of the UI Code is effective with the Sunday of the week in which the Notice is issued. The disqualification remains in effect until served or three-years from the mailing date, whichever comes first.

If we determine the potential overpayment was not your fault or was not due to fraud, you may qualify for an overpayment waiver. We will send you a Personal Financial Statement (DE 1446) with the Notice of Potential Overpayment.

To be eligible for a TE, you must: Have a current and regular unemployment claim. Meet all eligibility criteria to receive unemployment benefits. Start training before the current claim expires. Be approved for one of the training categories under CTB. Contact us before your sixteenth week of benefit payments.

You have the right to appeal the EDD's decision to reduce or deny you benefits. You must submit your appeal in writing within 30 days of the mailing date on the Notice of Determination and/or Ruling (DE 1080CZ) or Notice of Overpayment (DE 1444).

We will file your appeal with the California Unemployment Insurance Appeals Board local Office of Appeals but will not pay you DI benefits until a decision is made. It is important for you to attend your appeal hearing. If you fail to appear, the appeal will be dismissed.

While your appeal is pending, you must continue to certify for benefits. If you are found eligible, you can only be paid for periods for which you have certified, if you have met all other eligibility requirements. After your hearing, the Office of Appeals will mail the ALJ's written decision to you and your employer.
