California's Landmark Law In 2018, California voters passed the Prevention of Cruelty to Farm Animals Act — also known as Proposition 12 or Prop 12 — a farmed animal protection law requiring improved minimum housing standards for mother pigs in the pork industry, hens used in egg production, and calves raised for veal.

June 2022: NPPC/AFBF filed a joint brief arguing Proposition 12 violates the U.S. Constitution's commerce clause, which restricts states from regulating commerce outside their borders. July 2022: Amicus Briefs filed in support of the NPPC/AFBF case to review California Prop 12.

Proposition 12, as written: Bans the sale of pork from the offspring of sows kept in pens that do not meet its prescribed dimensions of 24 square feet per sow.

The California law being challenged bans the sale of pork within the state unless pregnant pigs are allowed at least 24 square feet of space and the ability to stand up and turn around in their pens. The measure was approved with more 68% of the vote as part of a 2018 ballot initiative known as Proposition 12.

Organization of the National Pork Board The Delegate Body has approximately 160 members. They include a minimum of 2 producers authorized from each of the 43 active pig-producing States, as well as importers.

The case was argued before the Supreme Court of the United States on October 11, 2022, during the court's October 2022-2023 term.
