When creating a waiver form, there are a few key elements that you will need to include: The name of the business and the event. A description of the risks involved in the event. A release of liability statement. The signature of the customer or participant.

When you sign a liability waiver, you agree to not hold the service provider liable for any injury you sustain as a result of ordinary negligence. Ordinary negligence is the failure to act reasonably as it relates to general safety.

In California, waivers of liability are generally enforceable so long as they have been drafted correctly, are explicit as to the scope of coverage, are legible and use high-visibility text, and do not illegally waive unknown or unrelated claims.

Members of the public who participate in any University sponsored activities that are subject to personal injury or property loss should sign a release of liability. For any activity where sports or physical activities are involved or which presents a danger to the participant, releases are required.

Utah's Supreme Court has held that both pre- and post-injury liability waivers signed by parents on behalf of their minor children are against public policy and therefore unenforceable.

Almost unanimously, states have ruled that waivers signed by minor children themselves are absolutely non-binding. Parental waivers must be signed by a parent or guardian if they are to be given full legal consideration.
