Updated May 14, 2022. A North Carolina general warranty deed is used to legally transfer property in North Carolina from one person to another. A warranty deed comes with a guarantee from the seller that the property has clear title.

General warranty deeds give the grantee the most protection, special warranty deeds give the grantee more limited protection, and a quitclaim deed gives the grantee the least protection under the law.

A traditional deed simply transfers the ownership of a property from one party to another (in other words, the seller to the buyer.) Whoever legally holds the deed is the rightful owner of the property. A warranty deed, on the other hand, contains special assurances that the seller makes to the buyer.

In order to be recorded in North Carolina, a warranty deed must be signed and properly acknowledged by the grantor before an officer authorized by the state to take acknowledgments of deeds. An individual form for acknowledgment by a grantor is presented in 47 38 of the North Carolina Statutes.

A general warranty deed does not now include a covenant against encumbrances. Because the grantor is making numerous present and future covenants about the title of the property being conveyed, a general warranty deed is the kind of deed that offers the most comprehensive level of protection to the buyer.
