In Virginia, landlord harassment is considered to be any action taken by a landlord that is intended to interfere with a tenant's right to quiet enjoyment of their rental property. Some examples of landlord harassment include: Entering the tenant's property without proper notice or permission.

Virginia residents do not have the right to withhold rent from the landlord, but for properties that do not meet health or safety standards or for material breaches of the lease agreement, tenants are able to take specific steps and then pay their rent into the court's escrow account instead of the landlord.

Repair and Deduct If landlord fails to make repairs affecting health and safety, tenant can contract with licensed contractor to get work done and deduct the cost from the rent. Tenant must first provide written notice to landlord and allow landlord 14 days to initiate the repairs.

The responsibilities of the landlord are as follows: Provide a dwelling that is safe and habitable. Abide by the terms of the lease or rental agreement. Make necessary repairs within 30 days of the maintenance request. If the issue causes health and safety concerns, it must be repaired in 24 hours.

Provide written notice to your landlord of the need for repairs. Give your landlord 14 days to start the repairs. You must give your landlord reasonable access to your home to do the repairs. If your landlord does not start repairs within 14 days, you can contract with a licensed contractor to do the repairs.

Code § 55.1-1254. If any items of personal property are left in the dwelling unit, the premises, or any storage area provided by the landlord after the rental agreement has terminated and delivery of possession has occurred, the landlord may consider such property to be abandoned.

§ 55-225.12 controls with respect to non-VRLTA leases. Both statutes allow a tenant to assert the existence of a condition that constitutes material non-compliance with the terms of the lease, a fire hazard, or a serious threat to the life, health, or safety of the tenant and to seek redress from the court.

If the problem is an emergency (such as no heat in winter, or no water), your landlord must fix it immediately. This means within hours, or at most a day or two. For other repairs, you should give a reasonable time, such as 10-15 days, to make the repairs needed.
