In order to operate legally, your food truck must have a license from the Texas Department of State Health Services (DSHS). You will also need a local county health department permit where you plan to do business. You can get these permits by completing an application and paying the required fees.

Get a Texas Food Handler's License (Texas Health & Safety Code § 437.0195 (2022).) In addition to the food handler permit, the food you sell must be packaged in a way that prevents contamination (there are exceptions for large items like wedding cakes) and is properly labeled.

Mobile Food Unit Mobile food units have the same requirements for food safety as restaurants. To open a mobile food unit you must submit a set of plans and fill out the Mobile Food Unit Plan Review packet. You will need to contact the Fire Marshal's office for an inspection.
