The new law, Texas House Bill 4758, makes it a Class "B" Misdemeanor for businesses and individuals to market, advertise or sell e-cigarette products to minors. That includes pictures of food, celebrities, or cartoon characters on their packaging.

In 2019, the 86th Legislature passed Senate Bill 21, increasing the legal age from 18 to 21 for the sale, distribution, possession, purchase, consumption or receipt of cigarettes, e-cigarettes or tobacco products.

The federal minimum age is 21 for the purchase of tobacco products, including cigarettes, cigars and e-cigarettes, with no exceptions. The Texas legal age is 21 for the purchase, distribution, possession, purchase, consumption or receipt of cigarettes, e-cigarettes or tobacco products.

The T21 law applies to sales of tobacco products – including cigarettes, smokeless tobacco, hookah tobacco, cigars, pipe tobacco, electronic nicotine delivery systems including e-cigarettes and e-liquids – to anyone under 21 years of age.

The Texas Smoking Tobacco law gives police the right to arrest you if they believe you smoked tobacco or used an e-cigarette in one of the prohibited places listed in the statute, including schools, libraries, hospitals, buses, elevators, and planes.

SALE OR PROVISION OF TOBACCO PRODUCTS TO A MINOR UNDER 18 YEARS OF AGE IS PROHIBITED BY LAW. UPON CONVICTION, A CLASS C MISDEMEANOR, INCLUDING A FINE OF UP TO $500, MAY BE IMPOSED. VIOLATIONS MAY BE REPORTED TO THE TEXAS COMPTROLLER'S OFFICE BY CALLING 1-800-345-8647.

This law is in Chapter 161 of the Texas Health and Safety Code. Unlike the federal law, it includes a few "grandfather clauses" that make an exception for: People 18 years of age or older with a valid U.S. or state military identification card; and. Anyone born on or before August 31st, 2001.
