The majority of courts use some variation of a random drawing. One simple method is to rotate the names of available judges. At times, judges having special expertise can be assigned cases by type, such as complex criminal cases, asbestos-related cases, or prisoner cases.

The participating Justices divide their petitions among their law clerks. The law clerks, in turn, read the petitions assigned to them, write a brief memorandum about the case, and make a recommendation as to whether the case should be accepted or not.

How does the Supreme Court decide to hear a case? If four judges agree to hear a case, the court issues a writ of certiorari. The two sides submit briefs to the Supreme Court and there is a one-hour hearing, thirty minutes per side. The justices then meet in private and vote.

After oral arguments, the Justices discuss the case in a private conference and decide how they will vote. If more than half the members of the Court agree on an outcome, their decision is written by one of the Justices (selected by the senior Justice among the majority).

The Justices use the "Rule of Four” to decide if they will take the case. If four of the nine Justices feel the case has value, they will issue a writ of certiorari.
