Rights as a Father As a parent, the father of a child has rights to that child. For example, a father is entitled to see his child. This means that he can ask the court for physical custody or visitation rights. Pennsylvania offers various forms of physical custody, including sole, primary, partial, and shared.

If you are not listed as the father on the birth certificate, you have no rights to custody, visitation, or paying child support. To establish a father's legal rights to their child, it is required that they establish paternity.

If you completed the AOP at time of your child's birth but the birth certificate does not list the father, please follow up with DHS at 800-932-0211 . Once you have verified that DHS has processed your AOP, complete a Request to Modify Parentage on a Birth Record.
