How to fill out the Canada CDE-1 - Alberta online
Filling out the Canada CDE-1 form for Alberta is a crucial step for individuals and corporations managing condominium properties. This guide provides clear and detailed instructions to help users navigate the online process efficiently and accurately.
Follow the steps to successfully complete the Canada CDE-1 form online.
- Press the ‘Get Form’ button to access the form and open it in the editor. Make sure you have a stable internet connection for a smooth retrieval.
- Identify the name of the condominium corporation. Enter the designated number associated with the condominium plan once it has been registered. If the corporation was established prior to September 1, 2000, use 'The Owners: Condominium Plan No. __________' as the title until a resolution is recorded to change it.
- For those registering a name change for corporations established before September 1, 2000, attach either an original copy of the Board of Director’s Resolution or a letter from the corporation. This enables the official renaming process to 'Condominium Corporation No. _________'.
- Complete the execution requirements by ensuring the name on the corporate seal matches the name recorded. Remember that only one signature under seal is necessary for examination purposes in accordance with the Land Titles Act.
- If there has been a change of address for service, include a notice in the required format and register a memorandum on the additional sheet. Be mindful that a fee will apply as specified in Tariff Item 11(1).
- After the annual meeting, submit a notice of the change of directors including their names and addresses within 30 days. This is done using the prescribed form (FORM 8) which must also have a memorandum recorded on the additional plan sheet, with its associated fee in Tariff item 11(6).
- Any amendments to bylaws require the registration of a notice regarding the resolution to be filed in the prescribed format (FORM 3) accompanied by a memorandum on the additional sheet. Fees will apply as per Tariff item 11(6).
- For common property transactions, or if leasing or transferring part of the common property, be sure to attach the appropriate certificate in the prescribed form (FORM 4), indicating that a special resolution has passed.
- To initiate termination of the condominium, file a notice in the prescribed format (FORM 5), and ensure appropriate memoranda are made on all sheets including the additional one. This step is essential as it may impact legal titles associated with the property.
- Lastly, review all entries for accuracy. Once completed, you can save the changes. Thereafter, download, print, or share the completed form as needed.
