Challenging a VAP Within 60 days after signing a VAP, a person may rescind their voluntary acknowledgment by signing a Rescission of Voluntary Acknowledgement of Paternity and submitting it in family court.

Parents must complete a form (HFS 3416 H: https://.illinois.gov/hfs/ChildSupport/Documents/hfs3416h.pdf) to request a certified copy of the VAP. The form must include a parent's original, notarized signature.

Rescission must be signed, witnessed and filed with the Department within 60 days from the effective date of either the VAP and/or the Denial, or the date of a proceeding relating to the child, whichever occurs earlier. Forms that contain errors will be rejected.
