The probate court will issue letters of administration and appoint a personal representative — also called an executor or administrator. The personal representative is normally the person named in the will, and the appointment is usually done within one to four weeks.

If the estate value is $1 million or less, your fee is 3% of the estate assets. If the estate value is between $1 million and $5 million, your fee is 2.5% of the estate assets. If the estate value is between $5 million and $10 million, your fee is 2% of the estate assets.

Copies of contracts, notes, leases, receipts, or other evidence in support of your claim must be attached to your statement of claim, and copied to each person sued and the court. The basic duties of the personal representative will be to collect and preserve the assets of the estate; to pay all debts of the decedent and expenses of administration including taxes; and finally to distribute the remainder of the estate to those persons entitled to it.
