A transfer on death (TOD) deed is like a regular deed you might use to transfer your Utah real estate, but with a crucial difference: It doesn't take effect until your death.

A survivorship affidavit (sometimes called an affidavit of death or affidavit of continuous marriage) is a legal document used to remove a deceased owner from title to property by recording evidence of the deceased owner's death in the land records.

Retains Control: With a TOD deed, you retain full control and ownership of your property during your lifetime.

You must sign the deed and get your signature notarized, and then record (file) the deed with the circuit court clerk's office before your death.

After a transfer on death deed is recorded, it can be revoked only by an effective revocatory instrument recorded prior to the death of the transferor and may not be revoked by a revocatory act taken against or on the original or a copy of the recorded transfer on death deed.

§ 64.2-624. Transfer on death deed authorized. An individual may transfer property to one or more beneficiaries effective at the transferor's death by a transfer on death deed.
