Filing an appeal with the United States Court of Appeals for the Federal Circuit is the final option after a trademark application is rejected. This appeals court will examine decisions made by both the USPTO and the TTAB and determine whether either party made an error.

A party may appeal a TTAB decision to a district court, where it is reviewed de novo. De novo review generally means that the district court can take a fresh look at all factual and legal determinations. Unfavorable decisions can alternatively be appealed straight to the Federal Circuit.

Generally speaking, you must answer a trademark opposition within 40 days of the TTAB instituting the opposition proceeding. You have to file the answer electronically through the ESTTA system and you have to properly serve a copy of the answer on the opposer (generally via email).
