New Jersey has had an Inheritance Tax since 1892, when a tax was imposed on property transferred from a deceased person to a beneficiary. Inheritance Tax is based on who specifically will receive or has received a decedent's assets, and how much each beneficiary is entitled to receive.

After the initial $25,000 exemption, the rates range from 11% on the next $1,075,000 to 16% for any transfer over $1 ,700.000. Class “D” – the law imposes a tax on the transfer of property with a value of $500.00 or more. The rates range from 15% on the first $700,000 to 16% for amounts over $700,000.

New Jersey does not levy an estate tax, making it one of 38 states with no estate tax.

Class A beneficiaries are exempt from the inheritance tax; they pay no inheritance tax. This group includes the deceased person's: spouse, domestic partner, or civil union partner. parent or grandparent.

If the estate generates more than $600 in annual gross income, you are required to file Form 1041, U.S. Income Tax Return for Estates and Trusts. An estate may also need to pay quarterly estimated taxes. See Form 1041 instructions for information on when to file quarterly estimated taxes.
