Leave without pay (LWOP) is an approved temporary absence from duty in a nonpay status re-quested by an employee. The term does not cover a suspension, furlough, an absence for which leave has not been approved, or nonpay status during hours or days for which an employee would be compensated on an overtime basis.

The Family and Medical Leave Act of 1993 (FMLA) provides covered employees with an entitlement to a total of up to 12 weeks of unpaid leave (LWOP) during any 12 month period for certain family and medical needs.

LWOP is a temporary non-pay status and approved absence from duty that may be granted at the employee's request. LWOP may be granted even if the employee has annual or sick leave in their accounts. The permissive nature of LWOP distinguishes it from absent without official leave (AWOL), suspension, and furlough.

Compensatory time is limited to an amount which, if it were paid in the pay period in which earned, would not cause the employee's aggregate pay (base pay plus premium pay) for that pay period to exceed the amount payable at the maximum rate for GS-15.

Most employees can carry a maximum of 240 hours of annual leave from one leave year to the next. "Use or lose" annual leave is the accrued annual leave above the maximum carry over amount. You must use your excess annual leave by the end of a leave year or you will "lose" it (or forfeit it).

Retirement. Your retirement coverage will continue without contributions from you. LWOP up to six months in a calendar year is fully creditable for retirement purposes. LWOP in excess of six months during a calendar year is not creditable.
