An unavoidable delay is an extraordinary circumstance which could cause delay in construction or repairs through no fault of the builder because of specified events, such as a strike, fire, explosion, act of God, civil insurrection, act of war or terrorism, or pandemic.

Tarion's role is to ensure that purchasers of new homes receive the coverage they are entitled to under their builder's warranty. Two-Year Warranty Coverage would apply to both the new construction and the pre-existing elements. These include: the two-year warranty for water penetration and defects in work and materials in the electrical, plumbing and heating delivery and distribution systems.

Tarion is making a lot of changes to improve consumer protection and modernize our operations. As part of this transition, we're going to be making a minor change to our name. Instead of 'Tarion Warranty Corporation', we will now just be 'Tarion'.

Delayed occupancy compensation up to a maximum of $7,500 is payable: If occupancy occurs on a date after the Firm Occupancy Date; or. If you exercised your right to terminate the purchase agreement due to delay as permitted by the Addendum (e.g., as per the Purchaser's Termination Period).

By law, a builder is permitted two extensions of 120 days each, without having to pay delayed closing compensation, provided that the homeowner was given proper written notice. After the 240 days have elapsed, the builder must set a Delayed Closing Date and the homeowner is entitled to delayed closing compensation.

In fact, enrolling in Tarion is mandatory for all new builds and means paying a fee. Two fees, actually: a Tarion warranty enrolment fee, plus an additional $145 “regulatory oversight fee” that goes to another provincial body, the Home Construction Regulatory Authority.

Major Structural Defect (MSD) The Major Structural Defect warranty covers years 3-7 and includes significant damage due to soil movement, major cracks in basement walls, collapse or serious distortion of joints or roof structure and chemical failure of materials.
