The Form 2 order is directed to the police in the same locality where the justice has jurisdiction and provides authority to the police to take the person named in the order into custody “forthwith” to an “appropriate place” where the person may be detained for examination by a physician.

A family can request a Form 2 from a Justice of the Peace if they believe that a person is a danger to themselves or others. The Form is valid for 7 days and allows the police to take the person to a hospital for assessment.

Section 2 allows for a person to be admitted to hospital, for up to 28 days, to assess whether they are suffering from a mental disorder, the type of mental disorder and/or how the person responds to treatment.

A Form 1 authorizes the holding of the person for up to 72 hours at a psychiatric facility. The Form 2 does not. A Form 2 authorizes the detention of a person just long enough for a doctor to make an initial examination and decide if a Form 1 is appropriate.
