The duty to provide notice of a related case is a continuing duty that applies when a party files a case with knowledge of a related action or proceeding, and that applies thereafter whenever a party learns of a related action or proceeding. CRC 3.300(f) (amended and renumbered eff 1/1/07).

Related cases are not consolidated cases. Related cases maintain their separate identities but are heard by the same trial judge. Consolidated cases, in contrast, essentially merge and proceed under a single case number.

Notice of Entry of Judgment or Order (CIV-130) Tells the parties that a judgment has been entered in a case. Service of this notice sets the start date of important deadlines regarding the ability to set-aside or challenge the judgment.

California Rules of Court, Rule 3.1203 states that “[a] party seeking an ex parte order must notify all parties no later than 10:00 A.M. the court day before the ex parte appearance, absent a showing of exceptional circumstances that justify a shorter time for notice.” (Emphasis added).

Whenever a party in a civil action knows or learns that the action or proceeding is related to another action or proceeding pending, dismissed, or disposed of by judgment in any state or federal court in California, the party must serve and file a Notice of Related Case.

Tells the court and other side that the dispute in the case has been settled by agreement of the parties, and that the case will be dismissed.
