Children between the ages of seven and 15 are prime candidates for juvenile court. Children as young as 12 and as old as 18 are typically taken to juvenile court, but increasingly, prosecutors are trying children in this age group as adults for very serious crimes.

Anyone 13 years old and above can be tried as an adult if he or she has a record of previously breaking the law or commits a serious crime. Minors who are 15 or 16 years old are automatically tried as adults for certain offenses, including murder, aggravated criminal sexual assault, and armed robbery with a firearm.

Currently, Georgia, Missouri, Michigan, New York, North Carolina, Texas, and Wisconsin are the only states that consider 16- or 17-year-olds adults in court, according to the Justice Policy Institute report.

Usually a juvenile is tried as an adult in an adult court system because of the severity of the crime committed. Examples of serious crimes include murder, robbery with a weapon, and rape. Juveniles can be tried as an adult in some common ways. The juvenile case will transfer from the juvenile court to the adult court.

Five states-- Georgia, Michigan, Missouri, Texas and Wisconsin--now draw the juvenile/adult line at age 16. Missouri raised the age of juvenile court jurisdiction to age 17 in 2018 and the law will go into effect January 1, 2021.

If the minor is over the age of 13 and is charged with certain violent crimes (e.g., rape, aggravated sexual assault, murder, voluntary manslaughter, armed robbery), the minor is considered an adult and will be tried as such, unless the court deems it appropriate to transfer the case down to juvenile court.

Although courts with juvenile jurisdiction handle a variety of cases, including abuse, neglect, adoption, and traffic violations, the Juvenile Court Statistics series focuses on the disposition of delinquency cases and formally pro- cessed status offense cases.

Sometimes the police officer will detain the minor, issue a warning, and then release the minor to the custody of a parent or guardian. Refer to juvenile court. The police officer may also place the juvenile in custody and refer the case to juvenile court.

A juvenile offender has the same legal protections during trial as an adult charged with a similar crime. The judge or jury will make a determination that the petition is "proven" or "not proven." If the judge finds that the petition has been proven, the case proceeds to a disposition hearing.

A delinquency petition is a petition that is filed by the prosecuting attorney in cases where a child under 18 years of age commits a delinquent act. ... A delinquency petition is a petition in the interests of a juvenile. It is filed by a prosecutor asking for a youth to be declared "delinquent" by the juvenile court.
