(e) Court order on joinder (A) The court must order that a person be joined as a party to the proceeding if the court discovers that person has physical custody or claims custody or visitation rights with respect to any minor child of the marriage, domestic partnership, or to any minor child of the relationship.

Typically, to terminate or modify your child support arrangement, you will need to complete paperwork and submit it to the court for approval. You will have file a request for a hearing (Form-FL 300) and ask the court to end child support payments. After you file, the clerk will assign a court date.

Default Judgment - If the noncustodial parent (NCP) does not file an Answer to the S&C within 30 days, and a stipulation has not been reached, the judicial officer may enter a Judgment by default.

Notice of Entry of Judgment or Order (CIV-130) Tells the parties that a judgment has been entered in a case. Service of this notice sets the start date of important deadlines regarding the ability to set-aside or challenge the judgment.

Code of Civil Procedure (“CCP”) section 1005 states the amount of time required to give notice of most motions. The moving papers must be personally given to each opposing side at least 21 days before the hearing on the motion, OR mailed to each opposing side at least 26 days before the hearing on the motion.

If you received a Notice of Motion (form FL-680) or an Order to Show Cause (form FL-683), it means the Local Child Support Agency (LCSA) has filed papers asking for a court date (a hearing). At the hearing, the court may make orders for child support or other issues.
