Estoppel is a legal doctrine that prevents a person from adopting a position, action, or attitude, asserting a fact or a right, or prevents one from denying a fact inconsistent with an earlier position if it would result in an injury to someone else.
An Estoppel Affidavit of Mortgagor sets out the current status of the mortgage or deed of trust. The Affidavit generally includes:
" Details of the registration of the mortgage or deed of trust and promissory note securing the loan;
" Remaining balance to be paid under the mortgage or deed of trust;
" Affiant has insured the property continuously covered by the mortgage or deed of trust;
" Property tax has been paid to date; and
" There are no existing liens against the property.
