This is an example of a discovery request with instructions propounded by the plaintiff to the defendant in a divorce proceeding, requesting information and documentation concerning the defendant’s earnings, assets and debts. Discovery is a term for the formal procedures used by parties to a lawsuit to obtain information and establish facts before a trial is called. Interrogatories and Requests for Production of Documents are common discovery devices. Interrogatories are written questions sent by one party to the other party for the latter to answer in writing under oath. A Request for Production of Documents is a request to a party to hand over certain defined documents. In family law cases, parties often request from each other bank statements, pay stubs and other documents showing earnings, assets and debts.
