Description Request Motion

In this example, the defendant is charged with Second Degree Murder but does not have sufficient information to properly prepare his defense. This request and motion by the defense is made pursuant to La. C.Cr.P. Article 716, et. seq. Discovery is part of the pre-trial litigation process during which each party requests relevant information and documents from the other side in an attempt to discover pertinent facts. Discovery devices include interogatories, requests for admissions, document production requests and requests for inspection. On motion of the defendant, the court may require the district attorney to furnish a Bill of Particulars setting forth more specifically the nature and cause of the charge against the defendant. See La. C.Cr. P. Article 484.
