This is an example of a letter from an attorney to a client he is representing in district court on a criminal matter. The letter relates the results of a discussion with an attorney representing said client in a federal matter, in which it was agreed that proceedings in the district court matter would be held back until the client’s sentencing in federal court. The reason for the delay is that, were the client to plead guilty in district court prior to sentencing in federal court, then that plea of guilty would be held against him in federal court, as federal sentencing guidelines are affected by the number of a defendant’s prior convictions.
